A WOMAN who defrauded the
Manitoba Community Newspaper
Association of over
$ 380,000 stemming from a gambling
addiction was sentenced to one year in
jail on Thursday.
Kim Beauchamp, 47, who pleaded
guilty to fraud over $ 5,000, was also
given three years of supervised probation
by provincial court Judge Heather
Pullan.
" It's clear there has to be some deprivation
of your liberty here," Pullan
told the court in sentencing. " The question,
really, is whether it's by conditional
sentence or by a term of incarceration."

own bank account

years weighed
heavy in the
decision, Pullan
noted.
" There were
24 times you had to make a decision
and you made it," the judge told Beauchamp.
In all, Beauchamp, who handled the
company's books, defrauded the MCNA
of $ 385,562 from 2009 to 2011. The association
had to pay a further $ 50,000
for a forensic audit and $ 30,000 to restructure
their financial accounting.
Beauchamp has since paid back
$ 100,000 in restitution.
The MCNA is a non- profit trade association
for the newspaper industry
that has been in existence since 1914.
Beauchamp had been employed by the
company since 2004.
Beauchamp's lawyer, Ryan Rolston,
had argued for a conditional sentence,
noting Beauchamp had no previous
criminal record and had expressed remorse
and was continuing to attempt
further restitution.
" You're dealing with somebody who
is the type of person who will continue
to berate herself and remind herself
of what she's done to herself and her
family," Rolston said. " If anybody feels
responsible and is the first to admit it,
that is Mrs. Beauchamp."
However, Crown attorney Jocelyn
Ritchot said if not for the initial restitution,
she would be seeking even more
than one year incarceration.
" She was in a position of great trust...
and she broke that trust," Ritchot said.
" It was a betrayal not only on a professional
level, but a personal level as
well."
The court heard Beauchamp used the
money to fund her addiction to VLT machines.
The fraud was only uncovered
after Beauchamp took an extended
sick leave and the billing irregularities
were discovered by her replacement at
the association.
The court heard Beauchamp not only
suffered from a gambling addiction, but
also depression, and on several occasions
wrote emails of confessions to the
fraud that were never sent. Beauchamp
was charged in September 2011.

A Winnipeg man blames an out- ofcontrol
gambling addiction for fuelling
a $ 2- million Ponzi scheme that
bilked unsuspecting investors.
Jack Michael Shapira, 48, was
spared a jail sentence this week after
pleading guilty to fraud over $ 5,000.
Instead, he was given a two- year conditional
sentence, which allows him
to remain in the community, albeit
under several restrictions, including
a curfew. He has also been put on
three years of supervised probation.
Shapira was arrested three years
ago following a lengthy RCMP investigation
that began with several complaints
from citizens who had poured
money into his company, Keywest
Leasing, between 2003 and 2008.
The clients were told their money
would be used for medical equipment
purportedly leased to health- care
agencies across the country. They
were also told to expect returns of up
to 30 per cent.
Police found some of the companies
named on the leases had no business
relationship with the investment
broker. Police say 11 investors lost
about $ 270,000, with the most recent
investors suffering the largest losses
because the broker was unable to
continue to find enough new investors
to finance returns for the earlier
investors.
As part of his sentence, Shapira
must make restitution payments to
his many victims. Shapira has no prior
criminal record and was desperate
for funds to cover the losses he was
incurring while gambling, court was
told.
