R ED DEER, Alta. - A man accused of killing a disabled woman with a pipe bomb disguised as a Christmas present told police he felt sick when they told him he was being charged with first- degree murder. A videotape of Brian Malley's statement to police was introduced as evidence in the fifth day of his Court of Queen's Bench trial in Red Deer, Alta., on Friday. In the video, Malley appeared worried and uneasy as he sat in a police interview room. The Crown has told the jury Victoria Shachtay received a settlement of $ 575,000 after a car crash left her a quadriplegic. Prosecutor Anders Quist said Malley, who was Shachtay's financial adviser, lost all of her money, was going into debt by giving her money out of his own pocket and killed her to cut his losses. Defence lawyer Bob Aloneissi has said evidence will show some of the woman's relatives had addiction problems and the real killer was someone who wanted to send a message to Shachtay or her family. During the videotaped police interview, Malley said his biggest concern at that moment was he wasn't going to go home that night. " I don't think I am with the way you're talking," he told an officer. That officer showed Malley some of the evidence against him and how police had come to find him a suspect. That included DNA evidence found in the postblast scene, records detailing the financial relationship between Malley and Shachtay and Shachtay'scaregiver, MarlenePunongbayan, identifying Malley as Shachtay's financial adviser. Earlier Friday, two witnesses testified to hardware- store purchases of items made four months prior to the bombing that matched the description of materials used to make the bomb. In January 2012, Kyle van Delft, an asset- protection specialist with Home Depot, was asked to use closed- circuit television and debit transaction records to identify a purchase made on July 17, 2011, at a Home Depot store in Red Deer. The Crown introduced 33 pages of Malley's many debit transactions at Home Depot in Red Deer over the previous months.
