APRIL Hornbrook was allegedly stomped on and kicked to
death by a man who wooed her after assaulting her boyfriend,
a court was told on Monday.
At the opening of the expected two week trial, Crown attorney
Paul Girdlestone told the seven- woman, five- man Manitoba
Court of Queen's Bench jury that Hornbrook's death was
a " tragic story of a killing.
" She lost her life at the age of 24 years... the Crown intends
to prove Max Maurice Richard beat and killed the victim."
Richard has pleaded not guilty to second- degree murder.
Hornbrook's body was found leaning against the wall
of an abandoned warehouse commonly known as the yellow
warehouse, just off Main Street north of the CP Rail
underpass, on Aug. 27, 2011. The warehouse has since been
demolished.
Girdlestone told the court Hornbrook and her boyfriend
were at the Northern Hotel early on Aug. 26, 2011.
The Crown said after Hornbrook was assaulted by her boyfriend,
he was thrown out of the hotel and assaulted by a group
of males that included Richard.
" Richard spent the remainder of the evening wooing April
Hornbrook," he said.
Girdlestone said he expects the jury will hear that Hornbrook
and Richard left the hotel and went a few blocks to the
warehouse " where for whatever reason the accused stomped
and kicked Ms. Hornbrook until she died."

A GULL Lake couple who kept dogs in
conditions so bad more than 30 of the
canines had to be euthanized may
find out today if they can own a dog before
their current five- year ban expires.
Justice Colleen Suche, of Manitoba Court
of Queen's Bench, has put the sentencing
appeal of Peter Chernecki, and his wife Judith,
over to today.
Last year, a provincial court judge sentenced
the 64- year- old Chernecki to four
months in jail, while fining his 63- year- old
wife $ 21,500. As well, the judge banned the
couple from owning or possessing animals,
except for two cats, for five years.
It is the fine and the five- year ban the
couple is appealing. Chernecki has already
served his jail sentence.
Defence counsel Bradley King called
the total fine " crippling" for a woman who
is unemployed.
King said the ban also falls out of the
range for sentencing people who until now
had no past convictions and who honestly
felt they were helping the dogs by not
sending them to a place where they might
be euthanized.
" We say the judge didn't get the balance
right," the lawyer said during an appeal
hearing on Monday.
" In their minds, keeping these unwanted
and stray dogs was part of the solution.
They thought they were part of the solution."
Court was told the couple was charged
after 64 dogs were removed in July 2010.
Thirty- four had to be put down, while seven
others were sent to the Dogtown USA
animal rehabilitation centre in Utah.
Most of the dogs lived in a 672- squarefoot
cabin with a floor of excrement, mud
and straw and one of the animals suffered
a major head wound.
During sentencing, Judge Carena Roller
called the couple's actions " heartbreaking
at best, and cruel at worst."
King told Suche dozens of people wrote
letters in support of the couple.
But Suche said the letters didn't really
help the couple.
" There are many people who spoke without
knowing what these people have done
to these animals," the judge said.
