T HE Crown is seeking six months in jail
for a disabled Winnipeg man who used his
vehicle as a weapon during an argument at
a gas station.
Robert Allen, 58, pleaded guilty this week to the
violent July 2013 incident on Henderson Highway
that was captured on surveillance video.
" This is a significant episode of road rage and
loss of temper," Crown attorney Nadine Vasas
told court.
Allen said he got angry with a female driver
who was honking at him as he tried to exit the
crowded parking lot after fuelling up.
Allen began screaming at the woman, which
prompted a male customer to intervene and push
him in the face, court was told.
Allen's glasses fell to the ground and broke.
Seconds later, Allen retaliated by deliberately
driving his car into the man's Volkswagen Beetle,
which was parked beside a pump.
He caused more than $ 1,200 damage but didn't
strike the man, who was with his young son.
There were no physical injuries.
" We can't sentence him on what could have happened.
We have to sentence him on what did happen,"
Vasas told court in explaining why a longer
penalty wasn't being sought.
Allen sped away after smashing the other
vehicle. He was arrested days later after his licence
plate was captured on video by witnesses.
" Holy crap," a female can be heard yelling on
the video that was played in court. " What the ( expletive),"
shouted another person.
Defence lawyer Ursula Goeres presented two
medical reports Thursday that show her client is
suffering from a permanent brain injury as a result
of a 2002 stroke. Side- effects include " angry
outbursts and threatening behaviour" when he
feels provoked - as he did on this day, court was
told.
" He has organic damage to the brain centre,"
Goeres said. She pleaded for leniency, saying
Allen should be given time served of two nights
in custody, followed by probation.
" He otherwise presents as a very congenial,
affable gentleman in most situations," Goeres
said.
The Crown wants the maximum six- month custody
sentence allowed for the charge of mischief
under $ 5,000. Allen has already paid Manitoba
Public Insurance for the cost of the damage.
" This behaviour needs to be punished," Vasas
said. " You cannot use your vehicle as a weapon
against another vehicle."
One of the main concerns is the fact doctors
say there is little they can do to control the violent
impulses.
Allen has shown poor judgment in the past.
He was convicted of uttering threats and discharging
a firearm for a 2009 incident that involved
a business dispute, court was told.
" He has an inability to control his temper," said
Vasas.
Provincial court Judge Carena Roller reserved
her decision until later this year.
She requested additional background information
about Allen.
Allen remains free on bail.
