OTTAWA — A Manitoba senator may be booted from her caucus over what she describes as an attempt to silence voices that want to reform the Red Chamber.
“It’s looking alarmingly like a kangaroo court right now,” Sen. Marilou Mc-Phedran told the ^Tee Press.
As first reported by the Globe and Mail, the Independent Senators Group is undertaking a procedure to have a closed-door vote Oct. 18 on whether to remove McPhedran from the group, which is the largest bloc in the Red Chamber.
The Globe reported the issue surrounds McPhedran emailing all senators last month with concerns about Sen. Sarabjit Marwah doing consulting work for the federal finance department. She had suggested Marwah may have breached ethics rules — to which he explained he had cleared the work with the ombudsman and law clerk in advance, and only received $1 in nominal compensation.
McPhedran apologized to Marwah and her colleagues for raising the issue. She claims she’s being cast out due to years of riling up her colleagues over what she deems to be inadequate policies to prevent harassment and abuse of expenses.
“As much as this appears to be a complaint from one of the richest, most powerful, male senators — and clearly it is that — it’s also about my strong position about the use of confidentiality (and non-disclosure) agreements in harassment procedures.”
McPhedran said there is a lack of transparency from the Independent Senators Group leadership, who would not provide anyone for an interview Wednesday. The group is committed to reforming the Senate and rebuilding the institution’s public image, but
McPhedran argues it’s falling short on both fronts.
She questioned why the caucus was moving to expel her instead of temporarily suspending her, as the group’s charter allows for either move when a senator breaches principles such as maintaining “decorous and respectful behaviour.”
McPhedran also accused the group’s leader, Sen. Yuen Pau Woo, of a conflict by being the person to launch the vote process and also the main person providing evidence in support of booting her.
Woo was unavailable for an interview Wednesday, but his staff provided a statement saying he’s simply following the charter all caucus members signed onto.
“When a question of expulsion arises, the charter provides for hearings to give an opportunity to examine the case, so all our colleagues can make up their own minds,” reads the statement attributed to Woo.
McPhedran was unsure how she’d proceed if she actually was removed. Senators can opt to remain unaffiliated with any caucus, but get less resources and a marginal voice in committee studies of legislation.
“I haven’t given it much thought, because you’re talking to an old, feminist war-horse here and I’m deep in the battle right now,” McPhedran said.
Prime Minister Justin Trudeau made all his Senate appointments non-partisan, breaching with decades of senators being members of parties whose votes could be dictated by the party leadership. The Red Chamber is still sorting out how to fulfil its mandate to represent regions and minorities outside of a party system.
“I think hard about the implications of being an independent senator for Manitoba,” said McPhedran, whom Trudeau appointed in October 2016.

PCs accused of breaking promise to add 1,200 care beds

THE provincial government has failed to keep its promise to add 1,200 new personal care homes beds across Manitoba since being elected in 2016.
The New Democrats released the results of an Aug. 25 freedom of information request Wednesday that show the Progressive Conservative government has only added 67 beds since being elected five years ago.
In 2020 and 2021, there were 9,765 licensed personal care home beds in the province. When the PCs took power in 2016, there were 9,698 beds, the document from Manitoba Health and Seniors Care shows.
Health Minister Audrey Gordon claimed her government has added more than 500 new long-term care beds since taking office, and she promised more would be added to the system.
“We’re going to continue to support our seniors and individuals requiring care at those facilities,” Gordon told reporters.
NDP Leader Wab Kinew accused “the minister is misleading the public,” and said the number of beds available to Manitobans has barely budged since the PC party took office.
“There may be an announcement of new beds, but typically it coincides with them taking older beds off-line,” he said.
Meanwhile, 810 people were on the waiting list for a personal care home bed in the province as of June, another NDP freedom of information request found.
That list is going to get longer once the notorious Parkview Place personal care home closes in August, Kinew said. The 261-bed building had a severe COVID-19 outbreak last year in which 30 residents died. It’s 60 years old and is “no longer conducive to the care of elderly residents,” its owner Revera has said.
“Manitoba will have 200 fewer personal care home beds than when the PCs took office,” Kinew said.

Empty building fee upheld for construction company
THE owner of a construction company being sued by the City of Winnipeg over the downtown police headquarters project was unable to get a separate city levy refunded Wednesday.
The city charged a $35,000 empty building fee for a property at 2233 McGillivray Blvd., which a civic report connects to Armik Babakhanians.
Babakhanians also owns Caspian Construction, one of several companies and individuals being sued by the city over fraud allegations linked to the Winnipeg Police Service headquarters project, which the city claims led it to be overcharged.
The allegations have not been proven in court.
Pam Anderson, speaking on behalf of the company, told council’s property and development committee the building’s owners have had trouble finding tenants since COVID-19 hit.
“The pandemic hit and our two tenants backed out. So 10 months into the pandemic, the City of Winnipeg imposed the empty building fee,” Anderson told the committee Wednesday.
The building has been used for storage, which does not qualify it as being occupied, she said.
The City of Winnipeg’s empty building fee is charged on structures left vacant after five or more annual inspections.
The committee voted to deny the refund, keeping the charge in place.
